JD Energy Pty Ltd (ACN 625 623 663) (us, we or JD Energy), trading as EnergiForge, is committed to managing personal and business information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth) and other applicable privacy and data-protection laws.

This document explains how we generally manage your personal and business information and is referred to as our Privacy Policy. In this Privacy Policy, “we”, “us” and “our” refer to JD Energy Pty Ltd and “you” refers to any individual whose personal or business information we collect.

This Privacy Policy applies to all personal and business information collected by us, or submitted to us, whether offline or online, including information collected or submitted through our websites (including https://energiforge.com and https://jdenergy.io), through our official social media pages, through the EnergiForge platform and related tools, and through HTML-formatted email messages that we send to you.

About JD Energy and EnergiForge

JD Energy Pty Ltd owns and operates EnergiForge, Australia's energy consultant for large business and developments. We combine dedicated independent energy experts with proprietary energy intelligence software. Our experts work across every energy niche (markets, behind-the-meter and networks) and are backed by software that unifies energy and asset data across sites, turning fragmented information into models, forecasts, scenarios and Board-ready strategy. A real person always owns the outcome.

Other terms which apply

Other terms may also apply to you and the information we hold about you. For example, if you are employed with us, you may have specific privacy terms in your employment contract. Clients and platform users are also subject to the EnergiForge Terms of Use and any applicable engagement or service agreement. Sometimes we provide a privacy collection statement at the time we collect personal and business information from you; this may include additional terms.

What information does JD Energy collect about you?

Clients, prospective clients and other business partners

Our clients are primarily large businesses and property developments. When your organisation enquires about our services, engages us, uses the EnergiForge platform or tools, or we otherwise do business with you, a record may be made which can include your personal and business information. The type of information we collect will vary depending on the context, but may include:

  • Personal contact details such as your name, title, email address, postal address and business contact details (including LinkedIn profile)
  • Geolocation information based on your interactions with us online
  • Information about your employer or organisation
  • Professional details (e.g. job title, role)
  • Energy usage and cost data (including electricity bills, interval data, consumption profiles and historical costs)
  • Details of energy and renewable assets (location, type, age, capacity, procurement and performance data)
  • Project, modelling, forecasting, budgeting and performance data entered into or generated by our software and experts
  • Other information you provide as part of your interaction with JD Energy or EnergiForge

We may occasionally collect “sensitive information” as defined under privacy laws, but only where relevant and lawful.

Prospective employees / applicants

We collect information such as your name, date of birth, contact details, qualifications, work history, references, licences and permits when recruiting. This may be obtained directly from you or from recruitment agencies, referees or professional platforms such as LinkedIn.

What happens if you don't provide your personal and/or business information?

You may decline to provide information, but this may limit our ability to deliver services, operate the platform, or conduct business effectively.

Visitors to our websites and platform

We use analytics tools and cookies / session technologies to understand and improve website and platform usage. Some data collected is aggregated or anonymised. Our websites and platform may contain links to third-party sites; JD Energy is not responsible for their privacy practices.

Can you deal with JD Energy anonymously?

Where lawful and practical, you may interact anonymously (e.g. general enquiries). Engagement for consulting services and use of the EnergiForge platform and tools usually require identification.

How does JD Energy hold information?

Information is stored in secure electronic databases (and occasionally archived paper records). We employ technical and organisational measures including firewalls, encryption, multi-factor authentication, access controls and physical security to protect data. Where the platform supports multiple clients, data is logically segregated.

How long will your information be kept?

Information is retained only as long as necessary for the purposes set out in this Privacy Policy or as required by law (including contractual, tax and regulatory obligations). Data is destroyed or de-identified when no longer needed.

Does JD Energy use or disclose information for direct marketing?

We may use your information for legitimate promotional purposes or to send updates about our services and events. You can opt out at any time using the unsubscribe link or by contacting us directly.

How does JD Energy use and disclose personal and/or business information?

  • Call and meeting recordings. JD Energy may record telephone, video and online calls/meetings with clients, prospective clients and business partners for quality assurance, training and record-keeping purposes. Recordings may include personal and business information and are stored securely in accordance with this Privacy Policy. By engaging with us you acknowledge and consent to such recordings (where applicable). If you do not wish for a call or meeting to be recorded, please advise us before or during the interaction.
  • For clients and other business partners. We may use or disclose your information to provide our consulting services, operate and improve the EnergiForge platform and energy intelligence tools, develop models, forecasts and strategies, manage relationships, deliver projects, and perform the work you engage us to do.
  • Disclosure to contractors and service providers. Information may be disclosed to trusted third parties (including cloud infrastructure providers, data processors, IT support, professional advisers and survey providers) who assist us in delivering our services. Related companies of JD Energy may also access information where appropriate and lawful.
  • Administration and management purposes. We may use or disclose information for billing, quality improvement, training, risk management, responding to complaints, obtaining professional advice, security and fraud prevention, and complying with legal obligations.
  • Business sale or corporate transaction. Information may be transferred to another entity as part of a sale, merger, restructure or other corporate transaction involving JD Energy or the EnergiForge platform.
  • Other uses and disclosures. We may use and disclose your information for other purposes described at the time of collection or as permitted or required by law.

How can you access or correct your information?

You can request access to, or correction of, your personal information by contacting our Privacy Officer. We will respond promptly and, if a request is refused, explain why (subject to any applicable exceptions under the Privacy Act).

What should you do if you have a complaint?

Contact our Privacy Officer with any concerns about our handling of your personal information. We aim to acknowledge and resolve complaints within 30 days. If unresolved, you can escalate to the Office of the Australian Information Commissioner (1300 363 992, www.oaic.gov.au).

How changes are made to this Privacy Policy

We may update this Privacy Policy periodically and will post the latest version on our website(s). Material changes will be notified where required by law.
